1. General Provisions

These Terms and Conditions ("Terms") govern your access to and use of the Switzerland Experience digital tour service ("Service"), including all related content, videos, and materials provided through our website and mobile application.

By purchasing access to or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

The Service is operated by Switzerland Experience ("we," "us," or "our"), based in Zurich, Switzerland.

2. Service Description

The Service provides a self-guided digital walking tour experience featuring:

• Location-based video content accessible via mobile device
• GPS-triggered proximity alerts at points of interest
• Historical and cultural information about tour locations
• Interactive map navigation assistance

The Service is designed to be used outdoors while walking. You are responsible for ensuring safe usage of your mobile device while navigating public spaces.

3. Purchase and Access

Access to the Service requires a one-time payment processed through Stripe, our third-party payment provider. Upon successful payment:

• You will receive immediate access to all tour content
• Access is valid for 7 days from the date of purchase
• Access is granted to a single user and is non-transferable
• Content may be downloaded for offline use during the access period

4. Refund Policy

We want you to enjoy the tour. If you are not satisfied with your experience, you may request a refund through the in-app refund form available in Tour Settings.

4.1 Refund Process

To request a refund, you must:

• Submit the in-app refund form with your email address and reason for dissatisfaction
• Submit the request within 7 days of purchase (during your access period)

4.2 Refund Evaluation

Refund requests are evaluated on a case-by-case basis. We reserve the right to decline refund requests that we determine to be fraudulent, abusive, or otherwise made in bad faith.

4.3 Refund Method

Approved refunds will be processed to the original payment method. Processing times may vary depending on your payment provider.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy of GPS or location data
• Warranties that defects will be corrected

6. Content Accuracy Disclaimer

The historical, cultural, and factual information provided in the Service is intended for entertainment and general educational purposes only. While we strive to provide accurate information:

• We do not warrant the accuracy, completeness, or reliability of any content
• Historical information may be simplified, dramatized, or condensed for presentation
• Information about locations, opening hours, accessibility, or services may change without notice
• The Service should not be relied upon as a sole source for academic, professional, or critical decision-making

We reserve the right to modify, update, or remove content at any time without prior notice.

7. Navigation and GPS Disclaimer

The Service uses GPS and location-based technology to enhance your experience. You acknowledge that:

• GPS accuracy varies and may be affected by buildings, weather, or device limitations
• Map data and walking routes are provided by third parties and may contain errors
• The Service is not a substitute for your own judgment, observation, or official signage
• You must always prioritize your safety over following suggested routes
• We are not responsible for any incidents arising from navigation errors or GPS inaccuracies

8. Limitation of Liability

This limitation applies to, but is not limited to:

• Personal injury, accidents, or health issues occurring during your use of the tour
• Loss of or damage to personal property
• Navigation errors or inaccuracies in location data
• Technical failures, interruptions, or data loss
• Any actions taken based on information provided in the tour content
• Interactions with third parties encountered during the tour
• Weather conditions, construction, closures, or other circumstances affecting tour locations
• Any loss of profits, data, goodwill, or other intangible losses

In jurisdictions where limitation of liability for certain damages is not permitted, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount paid by you for the Service.

9. Assumption of Risk

By using the Service, you acknowledge and accept that:

• Walking tours involve inherent risks including, but not limited to, uneven surfaces, traffic, weather conditions, and physical exertion
• Cobblestones, stairs, and historic pavements may be uneven or slippery
• Some locations may have limited accessibility for persons with mobility challenges
• Urban environments include traffic, cyclists, trams, and other pedestrians
• Weather conditions in Switzerland can change rapidly
• You are solely responsible for your personal safety and the safety of any minors under your supervision
• You should assess your own physical fitness and health condition before undertaking the tour
• You must comply with all local laws, regulations, and traffic rules while using the Service
• You should remain aware of your surroundings at all times and not use the Service in a manner that distracts you from potential hazards
• You must keep your device secure and be aware of pickpocket risks in tourist areas
• Using your phone while walking may distract you from hazards

10. Health and Physical Fitness

The Service involves walking through urban environments for approximately 1-2 hours. By using the Service, you confirm that:

• You are in sufficient physical health to undertake a walking tour
• You have consulted a medical professional if you have any health concerns
• You will take appropriate breaks and rest as needed
• You will stay hydrated and dress appropriately for weather conditions
• You will not use the Service while impaired by alcohol, drugs, or medication that affects judgment

We recommend carrying water, wearing comfortable walking shoes, and checking weather conditions before starting your tour.

11. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not attempt to circumvent, disable, or interfere with security features of the Service
• Not copy, reproduce, distribute, or create derivative works from our content
• Not use the Service in any manner that could damage, disable, or impair the Service
• Provide accurate information when making a purchase
• Maintain the confidentiality of your access credentials

12. Intellectual Property

All content included in the Service, including but not limited to text, graphics, logos, videos, audio, images, and software, is the property of Switzerland Experience or its content suppliers and is protected by Swiss and international copyright laws.

Your purchase grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only. You may not:

• Copy, modify, or distribute any content from the Service
• Use any content for commercial purposes without express written permission
• Remove or alter any copyright, trademark, or other proprietary notices
• Screen record, download (except through provided offline features), or capture video content
• Share your access credentials with others

13. AI-Generated Content Disclosure

You acknowledge that portions of the Service, including but not limited to videos, images, voiceovers, and avatar presentations, are created using artificial intelligence and machine learning technologies. Specifically:

• Visual content may be generated or enhanced using AI image generation tools
• Audio narration may be produced using text-to-speech technology
• Animated avatars may be created using AI-driven lip-sync and facial animation
• Historical scenes and reconstructions are artistic interpretations, not photographic records

AI-generated content is provided for entertainment and educational purposes. While we strive for historical accuracy, AI-generated depictions should not be considered definitive historical representations.

14. Translated Content and Subtitles

The Service provides subtitles and interface elements in multiple languages for user convenience. You acknowledge and agree that:

• Subtitles are automatically translated using artificial intelligence technology
• Translations may contain errors, inaccuracies, or unintended meanings
• The original English audio narration is the authoritative version of all tour content
• In case of any discrepancy between the English narration and translated subtitles, the English version shall prevail

We make no warranties regarding the accuracy, completeness, or reliability of translated content. Users who require precise information should refer to the English audio or seek independent verification.

Available subtitle languages may include: English, French, Chinese (Simplified), Spanish, Korean, Japanese, Arabic, and Hindi. Additional languages may be added or removed at our discretion.

15. Third-Party Content and Attributions

The Service incorporates content and services from third parties, used under their respective licenses:

• Maps: © OpenStreetMap contributors, licensed under the Open Database License (ODbL)
• AI Services: Content generated using commercially licensed AI tools including Stability AI, ElevenLabs, and similar services
• Historical Information: Compiled from public domain sources and original research

Third-party trademarks, logos, and service marks displayed in the Service are the property of their respective owners. Their use does not imply endorsement of the Service by these parties.

16. User-Generated Content

If you submit any content to us, including but not limited to feedback, suggestions, reviews, or comments ("User Content"), you grant Switzerland Experience a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, and distribute such User Content for any purpose, including improving the Service and marketing.

You represent and warrant that:

• You own or have the necessary rights to submit the User Content
• Your User Content does not infringe any third-party rights
• Your User Content does not contain unlawful, defamatory, or otherwise objectionable material

We reserve the right to remove any User Content at our sole discretion without notice.

17. Copyright Complaints

We respect the intellectual property rights of others. If you believe that any content available through the Service infringes your copyright, please contact us with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of where the allegedly infringing material is located within the Service
• Your contact information (name, address, email, phone number)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner

18. No Infringement Guarantee

While we make reasonable efforts to ensure our content does not infringe third-party intellectual property rights, we do not warrant or guarantee that the Service is free from claims of infringement. In the event of any third-party claim alleging copyright or intellectual property infringement:

• We may modify or remove the allegedly infringing content at our discretion
• We are not obligated to defend or indemnify you against such claims
• Your sole remedy is discontinuation of use and, at our discretion, a refund of any fees paid

19. Indemnification

You agree to indemnify, defend, and hold harmless Switzerland Experience, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any claim that your use of the Service caused damage to a third party

20. Third-Party Services and Links

The Service may contain links to or integrate with third-party websites, applications, or services, including but not limited to:

• Payment processing (Stripe)
• Map services (OpenStreetMap, Google Maps)
• External websites for additional information

We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of such services is governed by their respective terms and conditions. We do not endorse or make any representations about third-party services.

21. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, extreme weather conditions
• War, terrorism, civil unrest, or government actions
• Pandemics, epidemics, or public health emergencies
• Power outages, internet failures, or telecommunications disruptions
• Strikes, labor disputes, or supply chain disruptions
• Closure of tour locations due to renovation, events, or emergencies

In such circumstances, we will endeavor to resume the Service as soon as reasonably practicable, but no refunds shall be due for any period of unavailability caused by force majeure events.

22. Modification of Terms and Service

We reserve the right to:

• Modify these Terms at any time by posting updated terms on our website
• Change, suspend, or discontinue any aspect of the Service without prior notice
• Update tour content, routes, or locations at our discretion
• Adjust pricing for future purchases (existing purchases are not affected)

Continued use of the Service after any modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

23. Data Protection

We process personal data in accordance with Swiss Federal Act on Data Protection (FADP/nDSG) and, where applicable, the EU General Data Protection Regulation (GDPR). For details on how we collect, use, and protect your data, please refer to our Privacy Policy.

24. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Canton of Zurich, Switzerland.

If you are a consumer residing in the European Union, you may also be entitled to bring proceedings in the courts of your country of residence.

25. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

26. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter hereof.

27. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

28. Language

These Terms are provided in English. In case of any discrepancy between the English version and any translation, the English version shall prevail.
